Agreement to Terms

By accessing or using Blackthumb ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

Description of Service

Blackthumb is a mobile application designed to help users care for their indoor plants. The App provides features including but not limited to plant care reminders, light measurement tools, plant identification, and access to a plant care database. The service is provided "as is" and we do not guarantee specific results from using the App.

User Accounts

To use certain features of the App, you may need to create an account. You agree to:

Provide accurate and complete information when creating your account
Maintain the security of your account credentials
Promptly notify us of any unauthorized use of your account
Accept responsibility for all activities that occur under your account

Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorized access to the App or its systems
Interfere with or disrupt the App or servers connected to the App
Upload viruses, malware, or other malicious code
Collect or harvest user information without consent
Use the App to send spam or unsolicited communications
Reverse engineer, decompile, or disassemble any part of the App

User Content

You retain ownership of any content you submit to the App, including photos and plant notes. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the App. You are responsible for ensuring you have the right to share any content you upload.

Intellectual Property

The App and its original content, features, and functionality are owned by Blackthumb and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. PLANT CARE ADVICE PROVIDED THROUGH THE APP IS FOR INFORMATIONAL PURPOSES ONLY AND WE ARE NOT RESPONSIBLE FOR THE HEALTH OR SURVIVAL OF YOUR PLANTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACKTHUMB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Indemnification

You agree to indemnify and hold harmless Blackthumb, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the App or violation of these Terms.

Termination

We may terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Blackthumb operates, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms in the App or by other means. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
